About a month ago, the process involving the Hewlett Packard Enterprise (HPE), which charges a $ 3 billion related to the breach of contract of the Oracle, won new chapters near closure. In accordance with HPE, the process occurs due to lack of support for the Itanium chip that led to various damages and losses for the company. The California Court's decision was in favour of HPE, according to the Wall Street Journal disclosed this Thursday (30). Therefore, Oracle must pay the amount requested by the company.
" Oracle's decision to stop developing software on Itanium server platform in March of 2011 was a clear breach of contract that caused severe damage to HP and " to our customers, said John Schultz, Executive Vice President of HP's Enterprise. On the other hand, Oracle has denied irregularities. The company's Chairman, Larry Ellison, said that the company took measures to the end of the Itanium support because Intel had decided not to support more the chip. The argument was disproved by Intel.
With the end of the bracket, the HPE claims that would have suffered a big impact on sales. According to the company, the damage caused so far totals about $ 1.7 billion. In addition, the company believes it will lose more than $ 1.3 billion in future sales. The trial of the issue began in 2011, when HP presented a lawsuit against Oracle in a court in Santa Clara, California.
Steve Koenig, an analyst at Wedbush Securities, which comes with Oracle, said the amount paid must be " open " eyes of the company. Oracle has already resumed the Itanium development after a previous decision of the case. The company promised to appeal the jury's decision.
